Terms of Service

1. Provision as a Free Public Service

iCafes.net ("the Service", "the Directory", or "the Website") is operated and published by Webcentre ("Operator", webcentre.com.au) strictly as a free, voluntary public informational resource for community convenience.

The Service is provided entirely on an "AS IS" and "AS AVAILABLE" basis, without fee, charge, subscription, or monetary consideration required from visitors to browse directory content. Because this service is gratuitous, Webcentre and iCafes.net owe no fiduciary duty, duty of care, or performance warranty to any user.

2. Absolute Disclaimer of Accuracy & Verification Obligation

All directory information—including venue names, addresses, geographic coordinates, opening hours, pricing schedules, seating capacity, Wi-Fi throughput benchmarks, electrical outlet availability, computer specifications, and photos—is compiled automatically from third-party public open data sets (including OpenStreetMap contributors, the City of New York Open Data portal, Wikidata) or crowdsourced user submissions.

While reasonable algorithmic verification steps are performed, neither iCafes.net nor Webcentre warrants, guarantees, or makes any representation regarding:

• The completeness, accuracy, reliability, currency, or timeliness of any listing.
• Whether a listed venue remains in operation, has relocated, or has altered its business model.
• The availability, security, speed, or suitability of Wi-Fi networks, power ports, or hardware at any venue.
• The safety, suitability, cleanliness, or legality of any premises listed in the directory.

Obligation to Contact Directly: Users are expressly instructed and agree that they are solely responsible for contacting venues directly via telephone, official websites, or social media channels prior to travelling or relying on any directory entry.

3. Complete Exclusion of Liability (Zero Liability Cap)

To the fullest extent permissible under applicable law, neither iCafes.net, Webcentre, nor their respective founders, directors, employees, contractors, agents, affiliates, or licensors shall be held legally or financially liable for any direct, indirect, incidental, consequential, special, punitive, exemplary, or reliance damages whatsoever.

This total exclusion of liability applies to, without limitation:

• Any inaccuracy, error, typo, omission, or misinformation in any listing or database record.
• Any financial loss, travel costs, transportation fees, accommodation expenses, or wasted time incurred through relying on our directory or visiting a closed or misidentified establishment.
• Any physical injury, theft, property loss, or dispute occurring at or in connection with any third-party venue listed on the site.
• Any malware, security vulnerability, data interception, or network breach arising from connecting to Wi-Fi networks or computer terminals at any listed cafe.
• Any temporary downtime, server interruption, data loss, or termination of the iCafes.net website.

In jurisdictions where liability cannot be entirely excluded by law, the aggregate total liability of iCafes.net and Webcentre for any and all claims shall be strictly capped at $0.00 AUD (Zero Australian Dollars).

4. Third-Party Trademarks & Nominative Fair Use

All company names, brand names, product titles, service marks, logos, and registered trademarks displayed, cited, or mentioned on iCafes.net are the property of their respective trademark holders.

The inclusion, mention, or display of any business, computer brand, GPU/CPU model, gaming title, or establishment name is done strictly under nominative fair use for factual identification, cataloging, and public consumer directory indexing. Such display does not imply, represent, or constitute:

• Any endorsement, sponsorship, recommendation, or partnership by the trademark holder.
• Any affiliation between iCafes.net, Webcentre, and the mentioned brands or businesses.

5. Imagery, Data Attribution & Street View

iCafes.net incorporates spatial metadata, maps, and preview imagery from open and public sources:

• OpenStreetMap: Spatial coordinate data is sourced from OpenStreetMap contributors under the Open Database License (ODbL).
• Wikidata & NYC Open Data: Public facility metrics are ingested under CC0 / Open Public Data licenses.
• Google Maps & Google Street View: Street View imagery links and static previews are rendered directly in client browsers via official Google APIs or standard web navigation links. iCafes.net does not host, duplicate, or claim ownership over any Google Street View or Google Maps photography.

Neither iCafes.net nor Webcentre claims copyright or proprietary ownership over third-party imagery or exterior venue photography.

6. Notice & Takedown Procedure (Business Owners & Rights Holders)

iCafes.net respects all intellectual property rights and business privacy preferences. If you are a business owner, authorized operator, or copyright/trademark holder and wish to:

• Correct, amend, or update your venue details or hours;
• Request the complete removal and unindexing of your venue listing;
• Request the removal or replacement of any image or media associated with your venue;

Please submit a request via our Web Contact & Takedown Form or send a written notice to [email protected] / [email protected] including the URL of the listing and your business relationship. We will process your request promptly and without any fee.

7. User Submissions & Community Contributions

By submitting a venue listing, review, Wi-Fi speed test measurement, or comment, you warrant that your submission is lawful, accurate to the best of your knowledge, and does not infringe on third-party intellectual property or privacy rights. You grant iCafes.net and Webcentre a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, display, and publish the submitted data within our directory.

8. Indemnification

You agree to defend, indemnify, and hold harmless iCafes.net, Webcentre, and their respective officers, agents, and contractors from and against any claims, damages, liabilities, losses, costs, or expenses (including legal fees) arising from your use of the directory, your violation of these Terms, or your infringement of any rights of another party.

9. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the State of Victoria and the Commonwealth of Australia, without regard to conflict of law principles. Any dispute arising out of or related to these Terms or the use of iCafes.net shall be subject to the exclusive jurisdiction of the courts located in Victoria, Australia.
